Please read these terms carefully before using SmartMenuScan. They govern your use of our platform and outline the rights and responsibilities of both parties.
By registering for or using SmartMenuScan ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users — restaurant owners, staff, and customers viewing menus.
SmartMenuScan is a digital menu and restaurant management platform. It enables restaurants to publish live QR-code menus, manage table orders, notify staff, process billing, and view analytics. The platform is available under three tiers: Free, Pro, and Ultra. Features vary by plan; see the pricing page for a full breakdown.
Public-facing menu pages displayed to diners may include sponsored content placements. These are clean, non-intrusive placements that help sustain the platform. Sponsored content is displayed on the public menu regardless of the restaurant's plan tier.
You are responsible for maintaining the confidentiality of your login credentials. You must provide accurate information during registration. You are solely responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive or fraudulent behaviour.
The Free plan is free indefinitely. Pro and Ultra plans are paid subscriptions billed monthly or annually, as selected at checkout. All payments are processed securely via Razorpay. Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. You authorise us to charge the payment method you provide for all fees due.
Subscriptions renew automatically at the end of each billing period. You may cancel at any time from your account settings; cancellation takes effect at the end of the current paid period and you will retain access until then. We do not offer partial-period refunds unless required by applicable law or at our sole discretion.
We reserve the right to change plan prices with 30 days' advance notice. Continued use of a paid plan after the effective date of a price change constitutes acceptance of the new price.
The Free plan provides access to core menu-publishing features at no charge. The platform is sustained by a combination of revenue from paid Pro and Ultra subscriptions and sponsored content placements shown on public-facing menu pages.
Sponsored content placements appear on public menu pages viewed by diners across all plan tiers — Free, Pro, and Ultra. These placements are designed to be clean and non-intrusive and do not interrupt the ordering experience. The restaurant dashboard and management interface do not display sponsored content.
Sponsored content slots are sold directly by SmartMenuScan to businesses who want to reach diners. We vet all sponsors to ensure placements are relevant and appropriate for a restaurant context.
We reserve the right to modify, limit, or discontinue Free plan features with reasonable notice, though our intent is to keep a meaningful free tier available permanently.
You retain ownership of all content you upload to SmartMenuScan — menu items, images, prices, and restaurant information. You grant us a limited licence to store, display, and serve that content to your customers as part of providing the service.
You are responsible for ensuring your menu content is accurate, lawful, and does not infringe third-party intellectual property rights. We may remove content that violates these terms or applicable law.
You agree not to: (a) use the platform for any unlawful purpose; (b) attempt to gain unauthorised access to any system or data; (c) transmit spam, malware, or harmful code; (d) reverse-engineer or scrape the platform; (e) misrepresent your identity or affiliation; or (f) use the platform in a way that could damage, overload, or impair our infrastructure.
SmartMenuScan is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free service. To the maximum extent permitted by law, our total aggregate liability to you for any claim arising from your use of the platform shall not exceed the total fees you have paid to us in the three months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data loss.
We may update these Terms of Service at any time. We will notify registered users of material changes via email or an in-app notice. Continued use of the platform after the effective date of updated terms constitutes acceptance.
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
