Please read these terms carefully before using SmartMenuScan. They govern your use of our platform and outline the rights and responsibilities of both parties.
By registering for or using SmartMenuScan ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users — restaurant owners, staff, and customers viewing menus.
SmartMenuScan is a free digital menu platform. It enables restaurants to publish and update QR-code menus, customise menu branding, and view menu visit counts.
Public-facing menu pages displayed to diners may include sponsored content and third-party banner advertisements that help sustain the platform.
You are responsible for maintaining the confidentiality of your login credentials. You must provide accurate information during registration. You are solely responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these terms or engage in abusive or fraudulent behaviour.
SmartMenuScan provides its complete restaurant menu experience to registered restaurants. We may improve, replace, or discontinue parts of the service with reasonable notice.
The platform is sustained by sponsored content and advertisements shown on public-facing menu pages.
Sponsored placements are designed to be clearly labelled and do not appear in the restaurant dashboard or management interface.
Sponsored content slots are sold directly by SmartMenuScan to businesses who want to reach diners. We vet all sponsors to ensure placements are relevant and appropriate for a restaurant context.
You retain ownership of all content you upload to SmartMenuScan — menu items, images, prices, and restaurant information. You grant us a limited licence to store, display, and serve that content to your customers as part of providing the service.
You are responsible for ensuring your menu content is accurate, lawful, and does not infringe third-party intellectual property rights. We may remove content that violates these terms or applicable law.
You agree not to: (a) use the platform for any unlawful purpose; (b) attempt to gain unauthorised access to any system or data; (c) transmit spam, malware, or harmful code; (d) reverse-engineer or scrape the platform; (e) misrepresent your identity or affiliation; or (f) use the platform in a way that could damage, overload, or impair our infrastructure.
SmartMenuScan is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free service. To the maximum extent permitted by law, our total aggregate liability to you for any claim arising from your use of the platform shall not exceed the total fees you have paid to us in the three months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data loss.
We may update these Terms of Service at any time. We will notify registered users of material changes via email or an in-app notice. Continued use of the platform after the effective date of updated terms constitutes acceptance.
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
